Down Under Stay provides an online platform for students and young professionals to find and book shared accommodation in Sydney and surrounding regions. Our stays operate under a licence-style accommodation model, not a residential tenancy agreement, and therefore are not governed by the NSW Residential Tenancies Act (RTA).

By submitting an enquiry, scheduling an inspection, or confirming a booking, you acknowledge that you have read and accepted these Terms in full.

  1. Service Description

Down Under Stay manages property listings, inspections, and bookings on behalf of verified property owners and partners.

We aim to ensure that all details shown on our website are accurate and up to date; however, we cannot guarantee the continued availability, accuracy, or completeness of any listing, price, or property description.

We reserve the right to modify, suspend, or remove listings at any time without prior notice.

  1. Property Listings and Availability

3.1. All rooms and houses advertised on this website are subject to availability and approval.
3.2. Room images, floor plans, and descriptions are provided for illustrative purposes only and may differ from the actual property.
3.3. Prices may vary depending on seasonality, demand, duration of stay, and property-specific factors.
3.4. A booking is not guaranteed until confirmed in writing by Down Under Stay. We reserve the right to decline or cancel any booking at our sole discretion, including after a payment has been made, if the selected room becomes unavailable or unsuitable.
3.5. In such cases, a full refund of any payment received will be issued. No further liability will apply.
3.6. We are not responsible for listings that become unavailable due to maintenance, repairs, tenant extensions, or owner withdrawal.

  1. Inspections

4.1. Guests may book in-person or online inspections through our website.
4.2. For safety and privacy reasons, exact property addresses are shared only after a booking is confirmed.
4.3. The “Location” shown in the inspection form refers only to the general suburb or area.
4.4. Room conditions may vary from photos or videos due to normal wear and tear, furniture updates, or maintenance works.
4.5. Down Under Stay may reschedule or cancel an inspection in the event of unforeseen circumstances.
4.6. Guests must provide accurate contact details to receive inspection updates and confirmations.

  1. Bookings and Payments

5.1. To secure a booking, you must complete the shared accommodation agreement and pay any applicable deposit or fee as outlined in your confirmation email.
5.2. A booking is not final until written confirmation is issued by Down Under Stay.
5.3. Prices displayed in AUD may change without notice before a booking is confirmed and may vary based on season, demand, stay length, or availability.
5.4. We are not liable for price differences caused by exchange rates, international transfer fees, bank charges, or third-party platform fees. All such costs are the guest’s responsibility.
5.5. Payments must be made using the approved methods provided during the booking process.
5.6. Failure to complete payment within the specified timeframe may result in automatic cancellation.

  1. Cancellations and Refunds

6.1. Cancellations must be submitted in writing to info@downunderstay.com.au.
6.2. Deposits and booking fees are generally non-refundable unless stated otherwise in the confirmation email.
6.3. If a room becomes unavailable after booking confirmation due to circumstances beyond our control (e.g., property damage or early tenant extension), you will be offered an alternative room or a refund.
6.4. Down Under Stay is not responsible for any additional costs such as travel, relocation, or other expenses arising from a cancellation.
6.5. Refunds, where applicable, will be processed within 10 business days from approval.

  1. Check-In, Stay Conditions & Guest Conduct

7.1. Check-in and check-out dates and times will be communicated to the guest in writing after the booking has been confirmed. This communication may occur by email, WhatsApp message, or through another written channel used by Down Under Stay. Guests are responsible for reading and following the check-in instructions provided. Failure to follow the provided instructions may result in delays or inability to access the property, for which Down Under Stay is not liable.

7.1A. Check-in procedures may vary depending on the property, room type, or operational requirements. Down Under Stay reserves the right to adjust check-in or check-out times if necessary. Any changes will be communicated to the guest in advance whenever reasonably possible.

7.2. All guests must comply with property-specific house rules, including cleanliness requirements, quiet hours, guest restrictions, and shared area etiquette.
7.3. Guests must treat neighbours, other occupants, and property staff with respect at all times.
7.4. Smoking, illegal activities, and unauthorised events or gatherings are strictly prohibited.
7.5. Guests are responsible for any damage caused to the property or common areas during their stay.
7.6. Down Under Stay or the property owner may terminate a stay without refund in cases of misconduct, breach of rules, or behaviour that endangers others.

  1. Website Use

8.1. You agree not to use this website for fraudulent, misleading, or unlawful purposes.
8.2. While we strive to keep the site functional and secure, we do not guarantee uninterrupted or error-free operation.
8.3. Down Under Stay is not responsible for technical errors, miscalculations, or temporary service disruptions that may affect bookings.
8.4. We reserve the right to correct any errors in pricing, descriptions, or availability even after a booking request has been submitted.

  1. Limitation of Liability

9.1. To the maximum extent permitted by law, Down Under Stay and its representatives are not liable for any direct, indirect, incidental, or consequential damages arising from:
– use of this website,
– reliance on information provided,
– cancellation or unavailability of a room, or
– any issue during or after your stay.
9.2. Our total liability will not exceed the total amount paid to Down Under Stay for the affected booking.
9.3. Guests acknowledge that accommodation availability depends on property owners and external factors beyond our control.

We may update or modify our website, listings, or Terms at any time without prior notice.
The latest version will always be available on this page. Continued use of the website means you accept any updates.
